Manzeall - Host Terms and Conditions of Use

1. Introduction

These Host Terms and Conditions ("Host Terms") constitute a legally binding agreement between Manzeall and any individual, entity, or organization ("Host", "you") that submits or publishes property content on the Manzeall platform for the purpose of showcasing experiential staycations through video and multimedia content.

By submitting content, listing a property, or communicating with users via the platform, you agree to be bound by these Host Terms, our General Terms and Conditions of Use, and our Privacy Policy.

If you do not agree with these terms, you must refrain from using the Manzeall platform as a Host.

2. Role of Manzeall

Manzeall is a discovery and content platform that showcases curated staycation experiences via video-based content. We do not provide booking services, act as a travel agent, or process payments. Our platform enables users to discover hosts and properties and to communicate directly through features like chat or external links.

As a Host, you understand that:

• Manzeall does not verify or mediate transactions between users and hosts.
• Any financial transaction or service agreement initiated off-platform is your sole responsibility.
• Manzeall has no liability for service outcomes, disputes, or payments related to bookings or user engagement.

3. Host Eligibility & Obligations

To list a property or experience, you represent and warrant that:

• You own the property or have lawful authorization to promote and market it.
• You are legally able to enter into binding agreements.
• You comply with all applicable local, state, and national laws and regulations, including health, safety, tax, and zoning requirements.
• You will provide accurate, up-to-date information about your property and respond promptly to guest inquiries.

You must not:

• Misrepresent the nature or condition of your property.
• Discriminate against guests or users based on race, religion, gender, sexual orientation, disability, or other protected categories.
• Engage in fraudulent, misleading, or unethical conduct.

4. Content Submission & Intellectual Property

All content you submit to Manzeall, including but not limited to videos, images, text descriptions, and links, must be:

• Owned by you, or
• Properly licensed and cleared for use on a public platform.

You warrant that:

• You have obtained all necessary rights, releases, and permissions for any third-party materials included in your submissions, including but not limited to influencer appearances, audio tracks, or visual media.
• No submitted content infringes the copyright, trademark, or privacy rights of others.

By submitting content, you grant Manzeall a perpetual, worldwide, non-exclusive, royalty-free, sublicensable license to use, display, distribute, promote, and adapt such content across digital platforms owned or operated by Manzeall and in its marketing and editorial materials.

Manzeall disclaims all liability for copyright violations. You agree to indemnify and hold us harmless against any legal claim or financial damage resulting from the content you submit.

5. Host-to-User Communication

The Manzeall platform allows you to communicate with users directly via built-in messaging tools or links to third-party sites. You acknowledge that:

• You are solely responsible for the content, tone, and legality of any communication you initiate.
• You must not use the platform for spam, solicitation, harassment, or any form of abusive behavior.
• Any promotional material shared through the platform must be truthful and not misleading.

You may share external links for booking or payments. However:

• Manzeall is not responsible for the content or safety of any third-party links you share.
• You are entirely responsible for managing the transaction, fulfillment, cancellations, and disputes.
• Manzeall disclaims all liability arising from any transaction conducted outside its platform.

6. Reviews, Feedback, and User Interaction

Manzeall does not offer a public review or rating system. Users cannot post feedback, testimonials, or ratings on the platform. Hosts must not solicit, fabricate, or promote fake reviews or testimonials in any form that appear affiliated with Manzeall.

Any comments or reviews that appear in videos or promotional content must have proper consent and must not be presented as user-generated reviews from the Manzeall platform.

7. Payment Links and Off-Platform Transactions

Hosts may include or send external booking or payment links (e.g., their own website, WhatsApp, UPI, Razorpay, etc.). However:

• Manzeall does not verify, monitor, or endorse any such links.
• All financial, legal, or operational risks arising from the use of such links rest entirely with the Host.
• You are solely responsible for data security, refund policies, and the resolution of disputes that arise from off-platform transactions.
• If you misuse payment links or violate any law through financial conduct, Manzeall may suspend your account and report such behavior to relevant authorities.

8. Suspension and Termination

Manzeall may suspend or permanently terminate your account and listing access without prior notice if:

• You breach these Host Terms or the general Terms of Use.
• You submit misleading, unlawful, or harmful content.
• You infringe intellectual property rights.
• You engage in fraudulent or abusive behavior.

Upon termination, Manzeall may retain your content in archives for legal, editorial, or historical purposes but will delist it from active discovery.

9. Liability and Indemnity

You agree to release, defend, indemnify, and hold harmless Manzeall, its directors, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising208 out of:

• Any breach of these Host Terms.
• Any claim that your content infringes third-party rights.
• Any dispute or transaction between you and a user.
• Any legal or regulatory violation by you or your property.

Manzeall’s total liability shall not exceed ₹1,000 or the amount you paid to us, if any, in the preceding 12 months.

10. Modifications to These Terms

Manzeall reserves the right to modify, amend, or replace these Host Terms at any time. You will be notified of major changes via email or a notification on your dashboard. Continued use of the platform after such notice constitutes your acceptance of the revised terms.

11. Governing Law and Jurisdiction

These Host Terms are governed by and construed in accordance with the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts located in Mumbai.
